These Terms of Service govern your use of TidalVPN and any related apps, websites, and services we provide. By creating an account, purchasing a subscription, or using the service in any way, you agree to these terms.
1. Eligibility and account
You must be legally capable of entering a binding contract in your country of residence to use the service. You are responsible for keeping your login credentials confidential and for all activity under your account. You must provide accurate information and keep it up to date.
2. Subscriptions, billing, and pricing
Access to TidalVPN is provided on a subscription basis. Prices, features, and plan limits are described at the point of purchase and may change from time to time. Unless stated otherwise, subscriptions renew automatically at the end of each billing period and your payment method will be charged accordingly. You can cancel renewal at any time from your account before the next billing date.
3. Free trials, cancellations, and refunds
If offered, free trials or introductory offers are available once per customer unless we state otherwise. You may cancel at any time; your access will continue until the end of the paid period. Refunds are not provided for partial periods except where required by law or where we fail to deliver the service as described, in which case we may issue a full or partial refund at our discretion. If you are a consumer in the UK or EEA and you purchase online, you may have a 14-day right to cancel under consumer law unless you asked us to begin service immediately and acknowledged that this waives the cooling-off right once performance starts.
4. Acceptable use
You must not use TidalVPN for any unlawful, harmful, or abusive purposes. Prohibited behaviour includes, without limitation: infringing intellectual property rights; sending unsolicited bulk communications; distributing malware; attempting unauthorised access or scanning; interfering with networks or services; evading law-enforcement; sharing illegal content; or violating the terms of third-party platforms. Commercial reselling, shared accounts beyond permitted simultaneous connections, or operating exit nodes for public traffic without our written consent is not allowed.
5. Network management and fair use
To protect the network and other users, we may apply reasonable technical measures such as rate-limiting, traffic shaping, blocking abusive ports, or restricting connections that threaten service integrity. Fair use limits may apply as described on your plan page.
6. Privacy and data
Your privacy matters to us. We do not inspect the content of your encrypted traffic. We process limited account and operational data to provide, secure, and improve the service, as explained in our Privacy Policy available on our website. We do not sell your personal data. Partners will not receive your personal data for their own marketing unless you expressly opt in.
7. Marketing communications (maximum two per year)
We may send you occasional marketing emails about TidalVPN, including carefully selected partner promotions. We will send no more than two marketing emails in any calendar year. You can opt out at any time by using the unsubscribe link in the message or by updating your account preferences. Opting out of marketing does not affect essential service or transactional emails.
8. Software and updates
Any software we provide is licensed, not sold, and may update automatically. You must install updates promptly. You must not reverse-engineer, modify, or attempt to derive source code except where such restrictions are prohibited by law.
9. Intellectual property
TidalVPN, including our websites, software, branding, and content, is protected by intellectual property rights. You may use the service solely as permitted by these terms. All rights not expressly granted are reserved.
10. Third-party content and services
The service may interface with third-party sites or services. We are not responsible for third-party content, terms, or policies. Your interactions with third parties are solely between you and them.
11. Service availability and maintenance
We strive to provide a reliable service but do not guarantee that TidalVPN will be uninterrupted, secure, or error-free. We may suspend or limit the service for maintenance, security, legal, or operational reasons, and will act reasonably to minimise disruption.
12. Security
You are responsible for securing your devices and keeping your credentials safe. If you suspect unauthorised activity, change your password and notify us promptly via the support portal in your account.
13. Suspension and termination
We may suspend or terminate your access immediately if you breach these terms, if your subscription is unpaid, if required by law, or where your use risks harm to the network or others. You may terminate at any time through your account settings. Sections intended to survive termination will continue to apply.
14. Warranties and disclaimers
The service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we exclude all warranties, whether express or implied, including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, and non-infringement.
15. Limitation of liability
Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law. Subject to the foregoing, we will not be liable for: loss of profits, revenue, business, data, or goodwill; indirect or consequential losses; or any amounts exceeding the fees you paid for the service in the twelve months preceding the event giving rise to the claim.
16. Indemnity
You agree to indemnify and hold us harmless from claims, liabilities, damages, and costs arising from your breach of these terms or your misuse of the service, to the extent permitted by law.
17. Changes to the service or these terms
We may modify the service and these terms to reflect technical, legal, or business changes. If a change is material, we will give reasonable notice by email or by posting in your account area. Continued use after the effective date constitutes acceptance of the updated terms.
18. Transfer
You may not assign or transfer your rights or obligations under these terms without our prior written consent. We may assign these terms in connection with a merger, acquisition, or sale of assets, provided this does not adversely affect your statutory rights.
19. Governing law and venue
These terms and any dispute or claim arising out of them are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction, except that consumers resident in the UK or EEA may benefit from mandatory local consumer protection laws and bring claims in their local courts.
20. Severability and entire agreement
If any provision of these terms is found unenforceable, the remainder will continue in effect. These terms, together with any documents referenced in them, form the entire agreement between you and us regarding the service.
